“Os crimes de difamação e injúria não preveem qualquer agravante por ódio racial. O crime de injúria racial não existe no ordenamento jurídico português, ao contrário do que acontece, por exemplo, no Código Penal Brasileiro”, disse a apresentadora Miriam. No Código Penal português, a injúria é entendida apenas como “quem injuriar outra pessoa, imputando-lhe fatos, mesmo sob a forma de suspeita, ou dirigindo-lhe palavras, ofensivos da sua honra ou consideração”.

“Para que a injúria racial seja enquadrada no Código Penal, podemos olhar o artigo 240º do Código Penal (…) que se refere à discriminação e ao incitamento ao ódio e à violência… No entanto, para que a injúria racial seja crime com base neste artigo do Código Penal, é necessário que a conduta tenha sido tomada publicamente, através de um meio apto à divulgação. Assim, exclui desta norma qualquer conduta que tenha ocorrido entre agressor e vítima, mesmo publicamente, mas que não tenha ocorrido no meio destinado à divulgação, por exemplo à comunicação social. O que significa que a injúria racial só pode ser considerada no Código Penal português em termos muito limitados”, completa a apresentadora Miriam.

No mesmo vídeo, o programa “LEIturas” cita que a primeira condenação por discriminação racial em Portugal aconteceu em 2002. De lá para cá, em 20 anos, outras condenações foram “praticamente inexistentes”. Quando o artigo de discriminação é aplicado pela corte, a lei prevê até cinco anos de prisão.
